Gebruik thermische camera vaststellen kans op Corona

Nu het Coronavirus heel Nederland bezighoudt lijkt er op creatieve wijze te worden gezocht naar het kunnen detecteren van Corona bij werknemers, bezoekers, eigenlijk bij alle mensen die in de buurt komen.<\/p>\n

Er is ineens veel vraag naar thermische camera's. Dit lijkt te ontstaan doordat deze thermische camera's redelijk nauwkeurig kunnen aantonen of iemand het extra warm heeft en dus wellicht koorts.\u00a0Maar let op! De behoefte van mensen zichzelf te beschermen en daarbij de poging tot het voortijdig opsporen van 'oververhitte' mensen met een thermische camera mag niet zomaar.<\/p>\n

U heeft hier te maken met privacywetgeving. Waarbij het in de basis zo is dat cameratoezicht ALTIJD een inbreuk op iemands privacy is! Het meten van iemands temperatuur valt ook onder het verwerken van persoonsgegevens, dit levert dus direct een probleem met privacy op.<\/p>\n

Daarnaast is het zo dat er meerdere redenen kunnen zijn dat iemand het warm heeft: na bijvoorbeeld hevige inspanning, warm aangekleed, nervositeit, etc. Een directe link met het aanwezig zijn van koorts en vervolgens Corona kan en mag dus niet zomaar worden gemaakt!<\/p>\n

Wij willen u waarschuwen voor de vele onjuistheden die op dit moment worden verspreid over de inzet van thermische camera's in combinatie met het Coronavirus. Wij hebben Jeroen Terstegge gevraagd zijn visie over deze kwestie te geven. Hij is een autoriteit op het gebied van privacywetgeving.<\/p>\n

De problematiek is ingewikkeld. Toezichthouders in Europa spreken elkaar tegen over wat wel en wat niet mag. Van de AP zou zo'n warmtecamera waarschijnlijk niet mogen (\"alles via de bedrijfsarts\"), idem voor de Franse toezichthouder, andere toezichthouders zoals de Ierse hebben minder problemen met het vaststellen van Corona symptomen aan de poort.<\/em><\/p>\n

De AVG vereist \"Europees of nationaal recht\" die dit mogelijk maakt, maar de Nederlandse wetgeving hieromtrent is onduidelijk. De maatregelen van de regering om bij Corona symptomen thuis te blijven zijn slechts dringende adviezen en geen \"recht\" zoals de AVG vereist, zodat de rechtsbasis voor bedrijven en instellingen om gezondheidsgegevens zoals een verhoogde temperatuur van werknemers, klanten en bezoekers te verwerken lijkt te ontbreken.<\/em><\/p>\n

De verplichting om een veilige werkplek in te richten in artikel 3 lid 1, met name onder b, Arbowet is wellicht een rechtsbasis voor het scannen op Corona symptomen aan de poort. Voor bedrijven en instellingen die door de regering zijn aangewezen als 'vitale processen' en 'cruciale beroepen' heb je zelfs een zwaarwegend belang om w\u00e9l dit soort maatregelen te nemen. Maar we zijn dit allemaal nog aan het uitzoeken. Juist als deze crisis lang gaat duren, moeten de maatregelen juridisch houdbaar zijn. Het recht op privacy bestaat immers altijd, \u00f3\u00f3k in tijden van crisis. En dus moeten de maatregelen noodzakelijk en proportioneel zijn.<\/p>\n<\/blockquote>\n<\/div>
